Effective date: October 08, 2026
1. About these Terms
Omely is a production workspace for podcasters, interviewers, and independent creators. It combines a teleprompter, a recorder, timestamp markers, and a local guest roster in one app.
These Terms of Use (“Terms”) govern your access to and use of the Omely mobile application and any related services (the “App”). By installing or using Omely, you agree to these Terms. If you do not agree, please do not use the App.
These Terms are between you and Omely (“we,” “us,” or “our”), not Apple. Apple is not responsible for the App or its content.
2. Who may use Omely
You must be at least 13 years old to use Omely, or older if your local law requires a higher age for digital consent. If you are under 18, you confirm that a parent or legal guardian has allowed you to use the App. Omely is not intended for children under 13.
3. What Omely does
Omely helps you prepare and record interviews and solo episodes. Features include:
- Loading a script or outline into the teleprompter.
- Recording audio locally on your device.
- Dropping timestamp markers during recording.
- Saving guest profiles, bios, and private notes.
- Reviewing recordings with markers and annotations.
- Exporting audio and marker text for editing.
We may add, change, or remove features at any time.
4. Your recordings, scripts, and guest data
You may create and store audio recordings, teleprompter scripts, episode titles, guest profiles, photos, private notes, and other content (“Your Content”).
You keep ownership of Your Content. By using Omely, you give us permission to store and process Your Content only as needed to run the App on your device. Omely is designed as a local-first tool. We do not upload your raw audio, scripts, or guest notes to our servers unless you explicitly export them or contact us for support.
You are responsible for Your Content. You must have the legal right to record, store, and use any audio, image, or text you add to Omely. This includes getting consent from interview guests where required by law.
5. Recording laws and consent
Recording laws differ by country, state, and situation. Some places require all parties to consent to a recording. Others require only one party. You are solely responsible for complying with the recording, privacy, and publicity laws that apply to you and your guests.
Omely does not provide legal advice. Before recording anyone, make sure you have the necessary permissions and that your use of the recording is lawful.
6. Omely Coins and in-app purchases
Omely uses virtual tokens called “Omely Coins” for certain actions, such as creating a new episode project.
- New users may receive a starting Coin balance. The current amount is shown in the App and may change.
- Creating a new episode costs Coins. Editing an existing episode does not cost Coins.
- Coins are consumable in-app purchase items handled by Apple through the App Store.
- Coins are not money, have no cash value, cannot be transferred, and are not refundable except where Apple’s policies or applicable law require it.
- We do not receive your payment card details. Apple processes all payments.
- Coin packs, prices, and costs may change over time.
- Deleting the App or clearing local data may remove your Coin balance unless your build stores it on an account.
- Omely does not use subscriptions. All Coin purchases are one-time consumable packs.
Refund requests are handled by Apple. You can manage purchases in your Apple ID settings.
7. Acceptable use
You agree not to:
- copy, modify, or reverse engineer the App;
- use the App in any unlawful, harmful, or fraudulent way;
- upload malware or content that violates someone else’s rights;
- attempt to disrupt or overload the App or its related services;
- scrape, resell, or commercially exploit the App without our written consent;
- use automated tools to access the App without permission;
- record or distribute content that infringes copyright, privacy, or publicity rights.
8. Our intellectual property
The App’s software, design, graphics, logos, and trademarks belong to Omely or its licensors. We give you a limited, personal, non-transferable, revocable license to use the App for your own podcast and interview production. You may not use our branding without permission.
9. Privacy
Our Privacy Policy explains how we handle your data. It is part of these Terms. By using Omely, you agree to our privacy practices.
10. Third-party services
The App may link to or use third-party services, such as Apple In-App Purchase or the iOS share sheet. Those services have their own terms. We are not responsible for them.
11. Termination
You may stop using Omely at any time. We may suspend or end your access if you break these Terms or if we discontinue the App. Provisions that should survive termination will continue to apply.
12. Disclaimers
OMELY IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THAT ANY RECORDING WILL BE FREE OF LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMELY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST RECORDINGS, LOST PROFITS, LOST GUEST DATA, OR DAMAGE TO YOUR DEVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO OMELY IN THE 12 MONTHS BEFORE THE CLAIM, OR $50, WHICHEVER IS GREATER. SOME PLACES DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
14. Indemnity
You agree to defend and hold harmless Omely from any claims, losses, or expenses that come from your use of the App, Your Content, your recordings, or your violation of these Terms.
15. Apple-specific terms
You and we both acknowledge that:
